These Terms and Conditions of Sale govern all travel services, tours, itineraries, and reservations organized by Agence India Travel Arts LLP (hereinafter referred to as “the Company”). By confirming a reservation with the Company, the traveler acknowledges that they have read, understood, and accepted these Terms and Conditions in their entirety. These conditions constitute the contractual agreement between the traveler and the Company and apply to all services provided by the Company.
1. Booking Confirmation
All travel arrangements, tours, or reservations are considered definitively confirmed only after receipt of a deposit of fifty percent (50%) of the total cost of the trip. Until the deposit has been received and acknowledged by the Company, the requested services remain subject to availability and cannot be guaranteed. International bank transfers or payments made by credit card may require several business days depending on banking procedures and international transaction processing times. Once the deposit has been received, Agence India Travel Arts LLP will issue a unique booking reference number corresponding to the traveler’s file, confirming that the reservation has been secured. The remaining balance must be paid no later than forty-five (45) days prior to the traveler’s arrival date in India. Failure to settle the remaining balance within this period may result in cancellation of the reservation and the application of the cancellation conditions described below.
2. Cancellation of Travel or Services
Should the traveler wish to cancel a trip or any travel services arranged by the Company, the cancellation request must be submitted in writing by email to infos@indiatravelarts.com. In situations of exceptional urgency or during public holidays, travelers may also contact the Company by telephone at +91 82 3333 5370 to notify the agency as soon as possible. The Company will confirm the cancellation request and inform the traveler of the applicable cancellation charges. All cancellations are subject to administrative costs, supplier conditions, and the refund rules described in these Terms and Conditions. All bank charges related to international transfers or card payments remain entirely at the traveler’s expense, and a four percent (4%) banking transaction fee applied during payment processing is strictly non-refundable.
3. Refund Policy
Refunds will be processed according to the following conditions. If the cancellation occurs more than thirty (30) days before the scheduled arrival date in India, fifty percent (50%) of the advance payment may be refunded. If cancellation occurs between twenty-nine (29) and twenty (20) days before arrival, twenty-five percent (25%) of the advance payment may be refunded. If cancellation occurs nineteen (19) days or less before the scheduled arrival date, no refund will be granted. All refunds will be calculated after deduction of non-recoverable expenses, including administrative fees, supplier charges, and banking costs. Banking and payment transaction fees are always non-refundable.
4. Visa and Travel Documentation
Travelers are fully responsible for obtaining the appropriate visa and ensuring that all travel documentation is valid before departure. The traveler’s passport must be valid for at least six (6) months after the planned return date. In the event that a visa application is refused by the relevant authorities, the standard cancellation policy described in these Terms and Conditions will still apply, depending on the number of days remaining before the scheduled arrival date. Agence India Travel Arts LLP cannot be held responsible for decisions made by embassies, consulates, or immigration authorities. Travelers are advised to consult the official websites of the relevant embassies or consulatesto obtain the most up-to-date visa information and entry requirements.
5. Transport, Monument and Activity Tickets
All airline tickets, train tickets, boat tickets, monument entrance tickets, and activity tickets reserved through Agence India Travel Arts LLP are subject to the terms and conditions imposed by the respective service providers. Once issued or confirmed, these tickets are generally non-refundable and non-modifiable, in accordance with the policies of airlines, railway authorities, maritime transport operators, monument administrations, and activity organizers. In the event of cancellation, delay, schedule modification, or operational disruption caused by these third-party providers, Agence India Travel Arts LLP cannot be held responsible for the decisions or policies applied by those operators. Any possible refund will depend exclusively on the conditions established by the relevant supplier or authority.
6. Ayurvedic Treatments and Wellness Programs
Ayurvedic wellness programs and therapeutic stays are subject to specific booking and cancellation conditions imposed by the Ayurvedic centers and medical establishments involved. Because these programs involve medical consultations, treatment preparation, and accommodation arrangements that must be organized in advance, refunds are generally not possible once the reservation has been confirmed. In certain cases, a change of travel dates may be considered, but this remains strictly subject to the approval and availability of the Ayurvedic center. The Company is required to respect and apply the policies imposed by these institutions.
7. Festive Periods and Special Events
During major festive periods in India, including Holi, Diwali, Christmas, and New Year, hotels and service providers impose strict reservation conditions due to high demand. Bookings during these periods are frequently fully non-refundable and non-modifiable. These special conditions automatically apply to all reservations falling within these dates, and travelers acknowledge that Agence India Travel Arts LLP must comply with the contractual policies imposed by hotels and local suppliers.
8. Travel Insurance
Agence India Travel Arts LLP strongly recommends that travelers obtain comprehensive travel insurance before departure. Such insurance should ideally cover trip cancellation, medical expenses, emergency assistance, repatriation, and loss of luggage or personal belongings. While the Company does not provide insurance directly, it can supply all necessary documentation related to the reservation to assist travelers in arranging appropriate insurance coverage with their insurance provider.
9. Force Majeure
Agence India Travel Arts LLP shall not be held responsible for any failure, delay, modification, or cancellation of services resulting from circumstances beyond its reasonable control. Such circumstances may include, but are not limited to, war or threat of war, acts of terrorism, civil unrest, strikes, natural disasters, epidemics or pandemics, governmental restrictions, border closures, extreme weather conditions, or any other extraordinary event that could not reasonably be predicted or avoided. In such situations, the Company reserves the right to modify travel arrangements, postpone services, or cancel certain elements of the itinerary in order to ensure the safety of travelers and staff. Any refund or modification will remain subject to the conditions imposed by the relevant suppliers.
10. Acceptance of Terms and Jurisdiction
By confirming a reservation with Agence India Travel Arts LLP, the traveler confirms that they have read, understood, and accepted these Terms and Conditions of Sale in their entirety. These conditions constitute the legal framework governing the relationship between the traveler and the Company. Any reservation made with the Company implies full acceptance of these conditions. In the event of a dispute arising from the interpretation or execution of these Terms and Conditions, the matter shall fall under the exclusive jurisdiction of the competent courts of Jaipur, Rajasthan, India, and shall be governed by the laws of India.
